DESCRIPTION:Judge Noël Wise ruled against the City of Oakland on October 27\, 2023 in the “liability phase” of the state trial that began on July 10th\, stating “the Court finds the City breached the Parties’ Contract.” \nThe next phase of the trial will determine what remedy or damages are awarded to the would-be coal developers. It begins on Tuesday\, November 28\, 2023 at 9:00 am. \nIn the Judge’s order\, also published on October 27\, she wrote: “The damages phase of trial will begin Tuesday\, November 28\, 2023\, at 9 AM in Department 514. Based on previous trial estimates the Parties provided to the Court\, the Court anticipates closing arguments will be completed on Thursday\, November 30\, 2023\, but no later than the afternoon of Friday\, December 1\, 2023.” \nThus\, it is not certain whether the closing arguments in the “Remedy Phase” of the trial will concluded on Thursday\, November 30 or Friday December 1.
