SUMMARY:Final Hearing in Federal Coal Trial (CANCELLED)
DESCRIPTION:Judge Chhabria has CANCELLED the hearing first scheduled on March 28 then moved to April 5. His ruling in OBOT v City of Oakland will be issued without holding further hearings. He could issue his written ruling at any time\, in April or later. \nThe lawsuit is funded by Bowie Resource Partners\, the top coal producer in Utah\, which hopes to own and operate a coal terminal in West Oakland near the foot of the Bay Bridge.  Judge Chhabria focused the trial on the question of whether the City of Oakland had substantial evidence to support its enforcement of a ban on coal storage and handling on the Terminal project.  The City approved a Development Agreement in 2013 immunizing the project from changes in rules and regulations\, but the City has the power to impose new regulations provided they held a public hearing (which they did) and compiled substantial evidence that failure to impose the regulation would result in a substantial danger to the health and safety of West Oakland residents and workers at the site.  The three-day trial in January is described in our earlier posts which you can find here.  Check back before coming because Judge Chhabria sometimes calls off or changes the date and time of a hearing.

SUMMARY:Earth Day Celebration - West Oakland
DESCRIPTION:Coming together with Research and Data: Presenting Information from Real Time Equipment\nThis workshop is sponsored by the West Oakland Environmental Indicators Project (WOEIP)\, and will update residents of West Oakland with information from three air monitoring studies associated with a new Truck Management Program for West Oakland. The workshop will cover 100 x 100 air monitoring sensors placed throughout West Oakland; EDF/Google air mapping; and a study analyzing why filters on trucks are not working effectively at the Port of Oakland. The results of these studies will inform attendees of scientific findings about how black carbon — the main component of soot emitted from diesel engines\, wood smoke\, and other sources — varies throughout West Oakland. \nDuring this workshop\, participants will work together to determine how these data and our local knowledge can inform the City and the Port of Oakland to produce a truly comprehensive plan that minimizes air pollution in our neighborhoods. Here\, we will set priorities and recommend ways to ensure that this plan is an opportunity to ensure that air pollution does not persist in the places that matter most: where we live\, work\, play\, and pray. Join us in making an impact! \nFor more information\, please view the event flyer (PDF) or contact Ms. Margaret Gordon at 510-257-5647. \n  \n
