DESCRIPTION:There will be a general meeting of No Coal in Oakland on Wednesday\, January 3\, 2018 at 5:30 p.m. at the West Oakland Environmental Indicators Project (WOEIP). \nWOEIP is at 349 Mandela Parkway\, around the corner from the West Oakland BART station\, 1/2 block south of Fifth St\, behind the chain link fence and through the parking lot\, on the west side of the street. \nOn January 10\, 2018\, there will be a crucial hearing in developer Phil Tagami’s lawsuit against the City of Oakland seeking to overturn the City of Oakland’s ban on storage and handling of coal at the new shipping terminal to be built on public land near the foot of the Bay Bridge.  On January 10\, Judge Chhabria could decide the lawsuit in favor of the City or in favor of Phil Tagami or order the parties to proceed to trial on January 16. \nWe are planning a rally at 8:30 a.m. on January 10 outside the courthouse.  This meeting will focus on planning for our rally on January 10 and for our presence at the trial starting on January 16. \nWe meet regularly to plan actions that will strengthen Oakland’s resistance to coal.  Only through continued mobilization and a strong alliance with our neighbors in the labor\, faith\, environmental\, social justice\, climate justice\, racial justice\, public health\, and business communities can we ensure defeat of the plan to build the coal terminal.

SUMMARY:Hearing on Motions for Summary Judgment
DESCRIPTION:Join No Coal in Oakland for a rousing rally before the court hearing that could put an end to developer Phil Tagami’s lawsuit against the City of Oakland.  We are planning a spirited and informative gathering outside the Federal Courthouse in San Francisco at 8:30 a.m. before entering the Courthouse. \nAt 10 a.m.\, OBOT’s\, the City of Oakland’s\, and Sierra Club/SF Baykeepers’ Motions for Summary Judgment will be heard in the courtroom of US District Judge Vince Chhabria. At this hearing\, Judge Chhabria could decide the case and call off the trial if he considers that one side or the other is entitled to prevail as a matter of law.  If he decides that a trial is needed\, this hearing will be followed by a Pretrial Conference at which the final details of the trial starting on January 16 will be set. \nNo Coal In Oakland supporters are encouraged to come and observe the courtroom proceedings as well as participate in the rally beforehand.  Wear a red T-shirt in the courtroom to show our strength. \nTo get past security at the Federal Building\, you must present government-issued picture ID such as a driver’s license.  Judge Chhabria’s courtroom is Courtroom 2 on the 17th Floor. \nFor more information about the legal issues\, see our report.

The lawsuit is funded by Bowie Resource Partners\, the top coal producer in Utah\, which hopes to own and operate a coal terminal in West Oakland near the foot of the Bay Bridge.  Judge Chhabria has focused the trial on the question of whether the City of Oakland had substantial evidence to support its enforcement of a ban on coal storage and handling on the Terminal project.  The City approved a Development Agreement in 2013 immunizing the project from changes in rules and regulations\, but the City has the power to impose new regulations provided they held a public hearing (which they did) and compiled substantial evidence that failure to impose the regulation would result in a substantial danger to the health and safety of West Oakland residents and workers at the site.
