DESCRIPTION:Arguments before Alameda County Superior Court Judge Noël Wise (Department 514\, Hayward Hall of Justice) on issues raised by trial briefs filed by the opposing parties in OBOT v. Oakland\, a trial for which testimony in the first phase (concerning liability for competing breach of contract claims) concluded on August 31\, 2023. \nThe parties are briefing two highly technical but important issues that are likely to have a major impact on the outcome of the trial: \n\nRes judicata.  A basic principle of civil procedure is that a party cannot bring a second lawsuit on claims that were or could have been litigated in an earlier action. In other words\, the legal system does not allow two bites at the same apple. The parties dispute how this rule applies to the prior federal litigation\, which ended in mid-May 2018 with a decision by United States District Court Judge Vince Chhabria’s ruling that the City had insufficient evidence to support its banning of coal storing and handling at the proposed export terminal in West Oakland. The City argues that this rule bars OBOT’s claims that actions of the City before May 2018 breached the Ground Lease and that the City’s actions prior to June 14\, 2017 (when OBOT filed its final complaint in the federal action) excuse OBOT’s failures to meet their construction deadlines under the Lease.\nForce majeure. There are competing claims about how force majeure\, literally a “greater force\,” and legally an unforeseen event that prevents performance of contractually specified obligations\, applies in OBOT v Oakland. The opposing views on this issue\, as well\, will be argued before Judge Wise on this date.

Ogawa Plaza\, Oakland\, CA 94612\nSpeakers: Ms. Margaret Gordon\, No Coal in Oakland and West Oakland Environmental Indicators Project; Igor Tregub\, Sierra Club; Julia Dowell\, SF Baykeeper; Georgia Wallace\, Marlay’ja\, Youth vs. Apocalypse; and representatives from 350 Bay Area\, Communities for a Better Environment\, and Service Employees International Union\, Local 1021 \n\nOn Thursday\, October 27\, No Coal in Oakland and our grassroots coalition of community\, faith\, labor\, and environmental justice groups will hold a rally to denounce an attempt by would-be coal terminal developers to influence the Oakland mayor’s race with half a million dollars of out-of-town\, toxic money. \nOur coalition reaffirms our commitment to resist any effort to build a coal terminal in West Oakland and to support the City’s ordinance that bans storage and handling of coal and petroleum coke within city limits. \nThis summer\, only a few months after City Attorney Barbara Parker’s announcement that a deal was in the works to end the lawsuit over the West Gateway terminal and ensure a no coal future\, the developers backed out of settlement negotiations. \nIn recent weeks over $600\,000 has been donated to an Independent Expenditure Committee supporting Ignacio de la Fuente\, a mayoral candidate who has gone on record (Oaklandside\, Oct 3\, 2022) as being “in favor of the coal plan.” Most of that money comes from the Los Angeles-based hedge fund operator Jonathan Brooks. \nBrooks is the CEO of JMB Capital\, the big hedge fund behind Autumn Wind LLC. Autumn Wind\, headed by Vikas Tandon\, currently has the sublease on the property and threatens to develop and operate a coal terminal if local developer Phil Tagami wins his multi-million-dollar lawsuit against the City of Oakland. \nIt should alarm all voters that a total of $600\,000 of coal-related money has been donated by would-be coal developers — Jonathan Brooks and Phil Tagami through his shell-company OBOT — in a seeming attempt to buy Oakland’s mayoral election. \nOakland residents will elect our next mayor in just two weeks and the public must be aware of any effort by out-of-town\, would-be polluters to influence local elections and ongoing litigation with the City. With the future of our city’s air quality and the West Oakland community once again at stake\, No Coal in Oakland will rally to maintain that Oakland’s public health can’t be bought off – no coal\, not now\, not ever.

(NOTE: this vote was previously scheduled for Nov 5th; the Richmond City Council postponed the vote until December 3rd.) \nWHAT: Richmond City Council meeting \nWHEN: Tuesday\, December 3\, 6:30 pm; doors open at 6 \nWHERE: Richmond City Hall\, 440 Civic Center Plaza\, Richmond \nWe expect many people to show up in opposition\, as happened at the Planning Commission hearing\, so get there early. Faced with a rowdy show of force\, the commission voted to delay approval of the ordinance. SUMMARY:Ninth Circuit Hearing on Judge Chhabria's Decision Against Oakland
DESCRIPTION:In Courtroom 2\, 3rd Floor Room 330\, a panel of three Ninth Circuit judges will hear oral argument on the appeal by the City of Oakland\, Sierra Club\, and San Francisco Baykeeper\, from Judge Vince Chhabria’s decision after a three-day trial in which he struck down Oakland’s ban on on the storage and handling of coal at a terminal on City-owned waterfront near the Bay Bridge toll plaza. \nThe hearing will be open to the public. All supporters of No Coal in Oakland are encouraged to attend. We will bring you further details regarding the hearing and NCIO’s plans for November 12 as the hearing date approaches. \nThe parties will learn the identities of the three judges who will hear the case about a week before the hearing.  The Ninth Circuit has 29 active judges and 18 judges on senior status\, any of whom may be assigned to the panel.  The attorneys in the case will be keenly interested in who will be hearing the case and will seek to tailor their arguments to appeal to the known inclinations of the three judges on the panel. \n“Some judges always focus on the standard of review. Others often seem to know the record better than the lawyers appearing before them. Others like to engage the advocates in hypotheticals while others care about the pragmatic outcome of a case\,” explains appellate specialist MaryBeth LippSmith. \n[UPDATE\, 11/11/2019: our best estimate now is that the argument for the Oakland case will begin around 10am\, earlier than we first forecast.] The Court’s notice of cases shows that the panel in Courtroom 2 will hear one habeas and three criminal cases during the same morning session. If the four other cases are heard first\, the argument in the City of Oakland case will begin around 10:30 10:00 a.m.  The schedule can change without notice\, however\, so it is advisable to get to the courthouse before 9 a.m. in order to clear security and be seated in the courtroom at 9 a.m. \nThe Court has allotted 20 minutes of time to each side for the argument.  Assigned time limits are usually strictly observed so the entire morning’s calendar will be completed before noon. \nAfter the argument\, the Court will face no time limit to reach a decision\, but most Ninth Circuit cases are decided within 3 months to a year. \nThe Browning Courthouse is likely to be very crowded on November 12.  At approximately the same time as the City of Oakland hearing\, another three-judge panel will be hearing oral argument in the case brought by Sierra Club challenging Donald Trump’s attempt to redirect federal resources to build the wall on the U.S.-Mexican border. \nThe closest BART station is Civic Center. You must bring picture ID to get into the courthouse.  Phones may not be used in the courtroom and must be silent. \nFor those who cannot attend in person on November 12\, the hearing will be livestreamed and then archived. \n

In December\, Tagami filed a lawsuit — his second against the City — in state court asking the court to reinstate his lease\, give him a two-year extension to fulfill his obligations\, and award him hundreds of millions in damages.  The City moved to dismiss his lawsuit and the hearing on the motion is set for Thursday\, April 25 before Judge Jo-Lynne Q. The Heschel Room can be accessed from the disabled entrance opposite the bus stop to the right of the synagogue’s main entrance\, or through the main entrance and then down the stairs to social hall level.

SUMMARY:Richmond City Council: Coal and Petcoke Ordinance
DESCRIPTION:Richmond may be taking its first step toward ending the shipment of coal through the Levin terminal. \nA draft coal and petcoke ordinance is on the Richmond city council agenda this Tuesday!  The city council will be voting to direct city staff to review the proposed ordinance\, which if adopted will protect Richmond’s community from the health hazards of coal and petroleum coke.  Please come and express your support.  This is currently the very last item (L-7) on the meeting agenda\, but it’s possible it could be moved up.  Here are key talking points: \n\nThe export of coal from Richmond is not only a public health issue for the people who live directly next to the terminal\, but for every community that the uncovered coal trains travel through from Utah where the coal is mined.\nRichmond residents already suffer from high levels of asthma and other health-related issues from poor air quality.  This is a critical step to making Richmond a healthier place to live for residents and businesses.\nIn 2017\, the Levin-Richmond terminal shipped over 1.1 million metric tons of coal.  That’s a 300% increase over 2016 coal shipments\, and the terminal is on track to exceed that amount this year.  Our community cannot continue to be exposed to high levels of toxic coal dust and public health risks.\nThis is an opportunity for Richmond to phase out the export of coal and petcoke\, and fulfill residents’ desire to live in a healthier and safer community.\n\nFeel free to bring your own stories and concerns\, too!  It is also helpful to contact city council members to tell them that you support this coal ordinance: \nMayor Tom Butt tom.butt@intres.com\nJovanka Beckles jovanka_beckles@ci.richmond.ca.us\nBen Choi ben_choi@ci.richmond.ca.us\nEduardo Martinez eduardo_martinez@ci.richmond.ca.us\nAda Recinos ada_recinos@ci.richmond.ca.us\nJael Myrick jael_myrick@ci.richmond.ca.us\nMelvin Willis melvin_willis@ci.richmond.ca.us
