DESCRIPTION:For years\, developer Phil Tagami has been pushing to build a massive coal terminal in West Oakland. \nTagami was first backed by a coal company\, then by a former coal company executive\, and now by a hedge fund managed by Vikas Tandon. \nThe people and City of Oakland have always opposed siting a coal terminal on our waterfront! In 2016\, the Oakland City Council voted unanimously to ban coal\, and is now fighting in state court to stop the development for good. \nWe need your support to Keep Coal Out of Oakland! Please join us for a No Coal in Oakland Community Rally on Saturday\, July 22\, 2023\, from 12:00 – 1:30 pm\, at 732 Willow St. (between 7th St. & 8th St.) in West Oakland. Oakland\, a trial for which testimony in the first phase (concerning liability for competing breach of contract claims) concluded on August 31\, 2023. \nThe parties are briefing two highly technical but important issues that are likely to have a major impact on the outcome of the trial: \n\nRes judicata.  A basic principle of civil procedure is that a party cannot bring a second lawsuit on claims that were or could have been litigated in an earlier action. In other words\, the legal system does not allow two bites at the same apple. The parties dispute how this rule applies to the prior federal litigation\, which ended in mid-May 2018 with a decision by United States District Court Judge Vince Chhabria’s ruling that the City had insufficient evidence to support its banning of coal storing and handling at the proposed export terminal in West Oakland. The City argues that this rule bars OBOT’s claims that actions of the City before May 2018 breached the Ground Lease and that the City’s actions prior to June 14\, 2017 (when OBOT filed its final complaint in the federal action) excuse OBOT’s failures to meet their construction deadlines under the Lease.\nForce majeure. There are competing claims about how force majeure\, literally a “greater force\,” and legally an unforeseen event that prevents performance of contractually specified obligations\, applies in OBOT v Oakland. The opposing views on this issue\, as well\, will be argued before Judge Wise on this date. It begins on Tuesday\, November 28\, 2023 at 9:00 am. \nIn the Judge’s order\, also published on October 27\, she wrote: “The damages phase of trial will begin Tuesday\, November 28\, 2023\, at 9 AM in Department 514. Based on previous trial estimates the Parties provided to the Court\, the Court anticipates closing arguments will be completed on Thursday\, November 30\, 2023\, but no later than the afternoon of Friday\, December 1\, 2023.” \nThus\, it is not certain whether the closing arguments in the “Remedy Phase” of the trial will concluded on Thursday\, November 30 or Friday December 1.
